Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by SKE Cloud Private Limited, having its registered office in Delhi, India (“SKE Cloud”, “Company”, “we”, “us”, or “our”).

By accessing or using https://www.skecloud.com or any Virtual Private Server (VPS), cloud computing, data storage, private chat, collaboration, or related services (“Services”), you agree to be bound by these Terms.

Eligibility

You must be legally capable of entering into a binding contract and must provide accurate, complete, and up-to-date registration information to use the Services. Use of the Services is void where prohibited by law.

Scope of Services

SKE Cloud provides infrastructure-level services including virtual servers, cloud computing resources, data storage, backup solutions, and private or organizational chat and collaboration servers. Services may be managed or unmanaged, as specified at the time of purchase.

Customers retain full control over their systems, data, applications, communications, and user access. SKE Cloud does not control, initiate, or modify customer content.

Customer Responsibilities

You agree to use the Services only for lawful purposes and in compliance with all applicable laws, these Terms, and the Acceptable Use Policy. You are solely responsible for securing your systems, managing access credentials, maintaining backups, and ensuring that all users under your account comply with applicable laws and policies.

Intermediary Status

SKE Cloud acts as an intermediary under Section 79 of the Information Technology Act, 2000. SKE Cloud does not initiate transmissions, select recipients, or modify the information contained in customer data or communications.

Private Communications and Stored Data

Any data stored or communications transmitted using SKE Cloud Services, including private chat or collaboration servers, are the sole responsibility of the customer. SKE Cloud does not monitor, moderate, or access customer communications except as required by law.

Compliance with Laws

You agree to comply with all applicable Indian and international laws, including but not limited to the Information Technology Act, 2000, Information Technology Rules, 2021, and any applicable data protection or cybersecurity regulations.

Suspension and Termination

SKE Cloud may suspend, restrict, or terminate Services, with or without notice, if: you violate these Terms or the Acceptable Use Policy; we receive a lawful court order, government directive, or CERT-In notice; or continued service poses legal, security, or reputational risk to SKE Cloud or its customers.

Data Retention and Logs

To comply with applicable laws and CERT-In directions, SKE Cloud may retain logs, IP assignments, access records, and related account information for a minimum of 180 days. Such information may be disclosed only upon receipt of valid legal requests.

Payments and Billing

All fees must be paid in advance unless otherwise agreed in writing. Payments are non-refundable except where explicitly stated. Failure to make timely payments or initiating chargebacks may result in suspension or termination of Services.

Service Availability

Services are provided on a best-effort basis unless otherwise specified in a written Service Level Agreement (SLA). SKE Cloud does not guarantee uninterrupted or error-free operation of Services.

Limitation of Liability

To the maximum extent permitted by law, SKE Cloud shall not be liable for any indirect, incidental, special, or consequential damages. Total liability, if any, shall not exceed the amount paid by the customer for the affected service during the preceding billing cycle.

Indemnification

You agree to indemnify and hold harmless SKE Cloud Private Limited, its directors, employees, and partners from any claims, losses, damages, or expenses arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

Privacy

Use of the Services is subject to SKE Cloud’s Privacy Policy, which explains how personal data is collected, processed, retained, and disclosed in accordance with applicable laws.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts located in Delhi, India shall have exclusive jurisdiction over any disputes.

Changes to These Terms

SKE Cloud reserves the right to modify these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
